Or how about Maher Arar, a Canadian citizen, who we detained in 2002. At the time he was suspected of being a terrorist, but without any trial we "rendered" him to Syria where he was tortured and held for 10 months.

The military goes to great lengths to minimize civilian casualties. I know of many situations where we were fired upon and did not return fire due to the high risk of civilian casualties.
Salim Hamdan was sentenced to 5 1/2 years in prison and given credit for time served. He'll be back in Afghanistan in 6 months. That's a pretty far cry from "essentially going to be at Guantanamo for the rest of his life".
Maher Arar - this was a pretty raw deal but he was paid $10.5 million Canadian by the Canadian government. While I agree that's hardly compensation for a year of torture, it's something.
